Centre should take a decision on it not us: HC

Chief Justice Kalyan Jyothy Sen Gupta of the combined high court of AP and Telangana states has criticized the central government for escaping from its responsibility of dividing the high court. The high court bench led by him asked the council of the central government how the high court or the Andhra Pradesh Chief Minister Chandrababu Naidu can be blamed for the delay taking place in dividing the high court. He said that the court can start the bifurcation process if the President of India issue orders for it.

The court opines that the Centre that divides the Andhra Pradesh state has to take responsibility for setting up a separate high court for Telangana state. Hence, it should take a final decision and implement it, instead of seeking high court’s suggestion.

There was a misbelief in some people and Telangana lawyers also that the high court and the AP Chief Minister Chandrababu Naidu are obstructing the bifurcation process. Hence, the high court made it clear that the delay is due to central government’s indecision and neither Chandrababu Naidu nor the court can be blamed for it.
